Terms and Conditions

1. Definitions

• MakeMeFamous.nl: The trade name of the provider of AI portrait generation and personalized products
• Customer: The natural person or legal entity placing an order
• Product: AI-generated or custom image on various materials (posters, mugs, puzzles, etc.)
• Agreement: The agreement between MakeMeFamous.nl and the Customer
• Website: https://www.makemefamous.nl

2. Applicability

These general terms and conditions apply to all offers, orders and agreements between MakeMeFamous.nl and the Customer.

By placing an order, the Customer accepts these general terms and conditions.

Deviations are only valid if agreed upon in writing.

2.1 Age Requirement

To use our service, you must be at least 16 years old. If you are under 16 years of age, you may only use our services with the express consent of a parent or legal guardian.

By placing an order, you confirm that you meet the age requirements or have the required parental consent.

3. Offer and Contract Formation

3.1 Offer

All offers on our website are non-binding. Prices are in euros and include VAT, unless stated otherwise.

3.2 Contract Formation

A contract is formed when:

• The Customer places an order via the website
• The payment has been received and approved
• The Customer receives a confirmation email

3.3 Duty to Inform

The Customer is obligated to provide all required information (photos, address details) correctly and completely.

4. Prices and Payment

4.1 Prices

We reserve the right to change prices. Price changes have no effect on orders already placed.

4.2 Payment

• Payment is processed via Stripe (iDEAL, credit card, other payment methods)
• Payment must be received in full before the order is processed
• In case of non-payment, the order will be cancelled

4.3 VAT

All prices include 21% VAT in accordance with Dutch law.

5. Execution and Delivery Time

5.1 Processing Time

• AI generation: Immediately after payment (a few minutes)
• Production: 1 business day
• Delivery: 1-3 business days (depending on product)

5.2 Delay

In cases of force majeure or unforeseen circumstances, delivery times may be longer. We will inform you as soon as possible.

5.3 Delivery

• Delivery takes place at the address provided by the Customer
• Shipping via DHL and/or PostNL
• We deliver to all EU countries and Norway
• Track & Trace code is sent by email
• If absent, a notification card will be left

6. Right of Withdrawal (14-Day Cooling-Off Period)

6.1 Exceptions to the Right of Withdrawal

6.2 Withdrawal

For products to which the right of withdrawal applies:

• Contact us within 14 days at info@makemefamous.nl
• Provide your order number and return request
• Return the product within 14 days after notification
• The product must be undamaged and complete

6.3 Refund

• We will refund within 14 days of receiving the return
• Return shipping costs are borne by the Customer
• Refund is made via the same payment method as the original payment

6.4 Model Withdrawal Form

In accordance with EU Directive 2011/83/EU, we provide the following model withdrawal form. You are not obligated to use this form.

7. Use of Uploaded Photos

7.1 Customer Obligations

The Customer guarantees that:

• The Customer is the owner of the photos or has permission to use them
• The photos do not infringe any third-party copyrights
• The photos do not contain any illegal, offensive or inappropriate content
• Persons depicted in the photos have given their consent for use

7.2 Use by MakeMeFamous.nl

• Uploaded photos are only used to generate your portrait
• Photos are not stored after generation
• Photos are not shared with third parties, with the exception of the AI service provider Replicate (United States), on the basis of EU Standard Contractual Clauses — see our Privacy Policy for the full processing and transfer framework
• We never use your photos for marketing without permission

7.3 Right of Refusal

We reserve the right to refuse orders in case of:

• Copyright infringement
• Illegal or inappropriate content
• Photos that are not suitable for processing

8. Intellectual Property

8.1 Copyright on Output

The generated AI portrait is a joint work:

• You retain the rights to your original photo
• The AI-generated portrait is for personal use
• You may share the portrait on social media with attribution to MakeMeFamous.nl
• Commercial use (sale, reproduction) requires written permission

8.2 Website and Branding

All rights to the website, logo, texts and images belong to MakeMeFamous.nl. Use without permission is not permitted.

9. Warranty and Liability

9.1 Quality Guarantee

We strive for the highest quality, but cannot guarantee that:

• The AI result exactly matches your expectations
• Every photo is suitable for processing
• The result is identical to the original (it is an artistic interpretation)

9.2 Conformity

Products meet normal quality requirements. You have a statutory right to a conforming product (minimum 2 years after delivery, in accordance with art. 7:18a–7:18d of the Dutch Civil Code, implementing EU Directive 2019/771). In case of defects:

• Report visible defects as soon as possible; you have at least 2 months after discovery to notify defects by law (art. 7:23(1) Dutch Civil Code)
• Send photos of the defect
• We offer repair, replacement or refund

9.3 Limited Liability

To the extent permitted by law, our liability is limited to:

• Direct damages
• Maximum the order amount
• Damages covered by our insurance

To the extent permitted by law, we are not liable for:

• Indirect damages (consequential damages, lost profits), insofar as this does not conflict with mandatory consumer protection law
• Delays due to force majeure
• Errors in information provided by the Customer
• Infringement of intellectual property rights by the Customer

This limitation does not apply to:

• Claims based on statutory conformity (art. 7:17 Dutch Civil Code)
• Product liability (art. 6:185 Dutch Civil Code)
• Damage resulting from intent or gross negligence

10. Complaints

Complaints about products or services can be submitted via:

We aim to handle complaints within 14 days. For complex complaints, this may take longer, but you will be informed accordingly.

11. Dispute Resolution

11.1 Applicable Law

These general terms and conditions and all agreements are governed by Dutch law.

11.2 Competent Court

Disputes shall be submitted to the competent court in accordance with the applicable legal rules. Consumers may always submit disputes to the court of their place of residence.

For consumers, the court of the consumer's place of residence has jurisdiction, unless the consumer chooses another competent court.

11.3 Out-of-Court Dispute Resolution

We are not affiliated with any consumer dispute resolution body and are neither willing nor obliged to participate in out-of-court dispute resolution proceedings before a consumer arbitration board. Consumers can address complaints directly to us via the contact details in these terms.

12. Personal Data

For how we handle your personal data, including the use of cookies, tracking tools and sharing with third parties, please refer to our Privacy Policy and our Cookie Policy.

13. Changes

We reserve the right to amend these general terms and conditions. The most recent version is always available on our website. Changes do not apply to agreements already concluded.

For substantial changes, we will notify you by email at least 30 days in advance. You have the right to terminate the agreement within this period if you do not agree with the changes.

14. Final Provisions

In cases not covered by these general terms and conditions, actions shall be taken in accordance with reasonableness and fairness.

If any provision is void or annulled, the remaining provisions shall remain in full force and effect.
